GENERAL TERMS AND CONDITIONS


§ 1
The guest accommodation contract is considered concluded when the holiday apartment has been ordered by the guest and confirmed by the landlord. Both the written and the short-term verbal form are binding for the confirmation. The guest accommodation contract obliges guest and landlord to adhere to it and is only concluded between landlord and guest as well as the accompanying persons. Unauthorised accommodation of further overnight guests is only permitted after prior agreement.

§ 2
The lessor undertakes to make the holiday home available to the guest in perfect condition in accordance with statutory regulations or customary market practice. He is obliged to procure another accommodation for the guest if he is not able to make the promised holiday home available despite confirmation. The landlord also undertakes to rent the reserved holiday home elsewhere as soon as possible if the guest is unable to fulfil the contract and to repay the compensation paid in full or in part.

§ 3
If the guest withdraws from the contract before the beginning of the stay or arrives later or departs earlier than agreed, he is obliged to pay the landlord the agreed rental price minus the saved own costs for the days on which he does not make use of the reserved holiday apartment. Payment is due at the latest on the day of arrival of the agreed rental period and must be made in advance. The guest is obliged to pay the agreed or customary price if the contractual services are not used, less the expenses saved by the landlord. The Guest shall pay the calculated amount for the duration of the contract until the accommodation has been allocated elsewhere.

§ 4
Cancellation of the rental agreement
A cancellation by the tenant up to 8 weeks before the start of the rental period is free of charge, but the deposit remains with the landlord. 
If the tenant cancels less than 8 weeks but more than 4 weeks before the start of the rental period, 50% of the agreed rental price must be paid.
In the event of cancellation less than 4 weeks prior to the start of the rental period, 100% of the agreed rental price shall be payable.
It is therefore recommended to take out travel cancellation insurance.

§ 5
The day of arrival is considered a day of rental and is calculated as such. An overnight price is agreed upon. On the day of arrival the ordered holiday flat is available to the guest from 15 o'clock. On the day of departure, the guest must leave the apartment by 10 a.m. in order to give the landlord the opportunity to prepare it for the next guest.

§ 6
The rented object is handed over to the tenant in a clean and contractual condition. If there are any defects or if the inventory is incomplete at the time of handover, the lessee must notify the key holder/lessor immediately. Otherwise, the rented property shall be deemed to have been handed over in perfect condition. If damage occurs in the apartments which is caused by the guest, the guest is responsible for it; the guest is liable for all accompanying persons. A deposit may be required in advance in order to cover the costs of expected damages.

§ 7
Personal data of the customer will only be collected within the framework of the statutory provisions of the Federal Data Protection Act and the Teleservices Data Protection Act. They will only be made accessible to third parties insofar as this is necessary for the handling of the rental (cleaning service, property management, insurance, etc.). To the privacy policy

§ 8
Upon receipt of the booking confirmation, a deposit of 100 Euro is required. You will receive information about the payment together with the booking confirmation.

§ 9
The additional costs (such as electricity, gas, internet etc.) are included in the rental price. The bringing of dogs requires our consent. The guest is obliged to notify us in advance if he/she wishes to bring one or more pets with him/her. If we agree to bring pets with us, this is done under the condition that the pets are under the constant supervision of the guest and are free of disease and otherwise no danger to the other guests.

§ 10
The place of jurisdiction shall be La Gomera.

§ 11
Severability clause: Should one or more provisions of these GTC become invalid, this shall not affect the validity of the remaining provisions. The ineffective provision shall be replaced by an effective provision which comes as close as possible to the economic purpose pursued by the ineffective provision.
